(Austin, TX) — Plaintiffs in an effort to expand mail-in voting in Texas are giving up the fight, though a federal lawsuit continues.
State Democrats and civic organizations had sued to have the fear of coronavirus infection considered a disability for purposes of voting by mail. The Texas Supreme Court ruled against that effort, so the plaintiffs asked a state appeals court on Tuesday to dismiss their case.
A federal lawsuit is still in the works and may end up before the U.S. Supreme Court.
