(Washington, DC) — Texas believes the Justice Department can’t get involved in lawsuits involving the state’s new abortion law.
State Attorney General Ken Paxton filed a brief with the U.S. Supreme Court Thursday saying the Biden administration has no case because SB 8 is enforced by private citizens. It bans abortion after a fetal heartbeat is detected. It also allows people to civilly sue abortion clinics, doctors, and anyone who “aids and abets” a woman getting the procedure.
It was blocked by a district judge, but the Fifth Circuit Court of Appeals reversed the decision. The White House is hoping the Supreme Court will reverse the appellate court’s decision.
