(Erath County, TX) – An arrest has been made in an Erath County deadly hit and run accident.

51-year-old James Madison Day is charged with failure to stop and render aid in an accident involving death.  The charges stem from an October accident that took the life of Isaiah Cutler, whose body was found on the side of the highway in Huckabay.  According to the Stephenville Empire Tribune, Day’s daughters told investigators that their father admitted he struck and killed Cutler while trying to pass another vehicle.  Evidence at the scene was connected to Day’s pick-up.

Day is currently being held at the Erath County jail.
