(Austin, TX) — Republican officials in Texas want the state’s highest criminal court to reverse its recent ruling that the attorney general can’t proactively prosecute election cases.
Governor Greg Abbott, Lt. Gov. Dan Patrick, and other GOP leaders are urging the Court of Criminal Appeals to reconsider the decision. The all-GOP court ruled last month the attorney general’s power to pursue election cases violates the state constitution’s separation-of-powers clause unless he has the permission of local prosecutors.
Texas A-G Ken Paxton has filed a motion for rehearing.
